Exerpts from a Copy that was first published in: Mitteilungen der Magnus-Hirschfeld-Gesellschaft, >Heft 4, Oktober 1984.This was appendix 2 to the >report  given by the Magnus Hirschfeld Society to the International Gay and Lesbian Human Rights Commission (IGLHRC) for the Washington Conference on Holocaust Era Assets on the insufficient restitution for the loss of the >Institute for Sexual Science. 

I, the undersigned Dr. Magnus Hirschfeld, currently living in Nice, Hôtel de la Méditerranée, Promenade des Anglais, herewith declare the following as my last will and testament:

Article 2.

The main purpose of my present will, since I have no blood-related heirs, is to protect and to support the intellectual inheritance contained in my scientific, especially sexological, life work, after my own death. The personal bearers and administrators of this inheritance are my students.

Article 4.

I appoint my students and collaborators listed below as my only heirs, in equal portions, with the express condition that their portion of the inheritance is to be used not for personal use, but solely for the purposes of sexology in accordance with my sexological ideas, work and endeavors:

  1. Mr. Karl Giese of Berlin; his current address can be found out from Dr. Karl Fein, lawyer in Brünn (Brno) C.S.R., 6 Masarykowa.
  2. Mr. Li Shiu Tong of Hong Kong, currently with me in Nice.

Should one of these heirs die before me or not become my heir for some other reason, his portion accrues to the other.

Article 5.

Furthermore, I make the following bequests to the benefit of both of my aforementioned students:

  1. To Mr. Karl Giese I bequeath the objects rescued with his help from the Berlin Institute for Sexology, especially all of the documents, manuscripts, questionnaires, pictures, books, etc., etc., which are currently located in part in the garde-meuble of Bedel and Co. in Paris, 18 rue St. Augustin, in part still in Germany (Berlin, Wiesbaden) or Saarbrücken, in a location known to him.

    Furthermore, I bequeath to Mr. Karl Giese the income from all of my writings and books in German and other languages, including translations, as well as from licenses for medications.

    Like the inheritance mentioned in Article 4, Mr. Giese receives these bequests with the express condition of using them for an archive or institute for sexology.

  2. To my aforementioned student Li Shiu Tong, I bequeath all the shares which are currently in a bank safe in Paris in his and my name. With this bequest, the debt that I was forced to gradually accrue with him following my persecution in Germany should be paid off at the same time. Further, I bequeath to him all the books, papers, pictures and other objects which are located at the time of my demise with me, with him, or in joint safekeeping, e.g., in Paris in the Hôtel Quai d'Orsay, with the exception of monitary amounts (paper money, foreign currency, checks, etc.), which are to be used first by the executor of the will to pay off the family and other legacies listed in the further articles of this will. I make these bequests to my student Li Shiu Tong with the express condition that they are to be used not for personal use, but solely for the purposes of sexology in accordance with my endeavors.

Article 6.

Furthermore, I expressly determine that my students Karl Giese and Li Shiu Tong must see to it that the objects and assets given to them for use in serving the purposes of sexology are maintained for this purpose as much as possible after their own deaths, possibly through the foundation of a legal entity, e.g., an association, during their lives.
